Terms and Conditions:

**1. Definitions:**

– “Supplier” refers to Everyday Adventure (Pty) Ltd t/a GSGear.co.za

– “Customer” refers to any individual or entity placing an order on GSGear.co.za.

– “Goods” refer to any product or service available for purchase on GSGear.co.za.

**2. Acceptance of Order:**

All orders placed by the Customer are subject to acceptance by the Supplier. An order is considered accepted only when the Supplier provides a confirmation of acceptance in writing (including electronic communication such as email). The Supplier reserves the right to decline any order at its sole discretion.

**3. Pricing:**

All prices listed on GSGear.co.za are subject to change without notice. Prices are inclusive of VAT, unless otherwise stated.

**4. Errors and Omissions Excepted (E&OE):**

All information provided on GSGear.co.za, including but not limited to prices, product descriptions, and images, is subject to errors and omissions. The Supplier shall not be liable for any errors or inaccuracies, and reserves the right to correct any errors or omissions at any time without prior notice. The Supplier also reserves the right to cancel or modify any order affected by such errors or omissions.

**5. Payment:**

Payment must be made using one of the approved methods listed on GSGear.co.za. Goods will not be dispatched or services rendered until full payment is received and verified.

**6. Delivery:**

The Supplier will endeavor to deliver Goods within the specified time frame, but delivery times are estimates and cannot be guaranteed.

**7. Returns and Refunds:**

Any return or refund requests must be made in accordance with the Supplier’s return and refund policy GSGear.co.za.

**8. Limitation of Liability:**

The Supplier’s liability in connection with any sale shall be limited to the purchase price of the Goods in question. The Supplier shall not be liable for any indirect, special, incidental, or consequential damages arising out of any transaction.

**9. Governing Law:**

These terms and conditions are governed by and construed in accordance with the laws of South Africa. Any disputes arising from or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of South Africa.

**10. Changes to Terms and Conditions:**

The Supplier reserves the right to amend these terms and conditions at any time. Changes will be effective when posted on GSGear.co.za.

**11. Severability:**

If any provision of these terms and conditions is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

**12. Entire Agreement:**

These terms and conditions, together with the Supplier’s Privacy Policy and any order confirmation provided by the Supplier, constitute the entire agreement between the Supplier and the Customer regarding sales on GSGear.co.za.

 

Consent to Collect and Process Personal Information

I/we hereby voluntarily give my consent and authorise Everyday Adventure (Pty) Ltd t/a GSGear.co.za (hereafter referred to as the Service Provider) to collect and process my personal information for the specific purpose of assessing selling and delivery products through the website.

Such consent is given to the Service Provider for as long as is needed for the site to be assessed and repaired.

I hereby declare that the information provided is correct and accurate.

You have the right to lodge a complaint to the Information Regulator.

You may also request as to whether information is held on you, and a copy thereof (a fee may be payable) may be requested, and that the information may be corrected or deleted.
